I have been working with a reputed organisation A for one year and have tendered my resignation on a good note. My cause for resignation was not due to some monetary benefit but due to some undisclosable issue. My company's seniormost managers tried to convince me not to leave and asked me the reason for the resignation which I couldn't reveal since it could have hampered someone's career.

In the meanwhile I got a job with another organisation B who wanted me to join in one month's time whereas the notice period in A was 2 months. My immediate mentor accepted the resignation but not my top managers. And finally when they did they were not ready to reduce the notice period which they stated at the end of the 1st month of notice period. I responsibly had handed over my work to my colleague and finally left after sending a request mail to top manager to waive off my notice period by one month. They refused to do so but I had to join B by then so I stopped reporting to A.

A blocked my one month's pay and sent me a notice that I am legally required to serve another month's notice.

What can be the implications of this notice. Please suggest. My new organisation B is ready to buy me out.



Please do help me as this has been giving me sleepless nights.

Notice period is an internal matter of respective organisation. Still if an employee requests for waiver of notice period, normally, the company should waive it. Insisting on notice is really an unfair practice of the management. Even in the case of establishments having standing orders do make flexible rules. And I don't think that any company has filed any suit against a former employee for recovery of notice pay. Therefore, my advice is to forget the notice.

Thanks a lot for your advice and wish that I end my association with my previous organisation on a very good note. I also hope they don't ask me to pay exorbitantly citing some liability issue like loss of mandays due to my absence.
