Hi all ,
I do not have exact idea about the maternity leave policies or law , so I need to understand what I can do about it. My wife works in a private BPO firm , its a big BPO , and she will delivering our child in 1 or 2 months time . But when she went to take approval for her maternity leave from AVP hr of company , the AVP hr person talked rudly and denied the application by saying that she needed to apply or take approval for leave well before 3 months of delivery and its a company policy .
So my questions are
1. can anybody deny maternity leave on the basis of such policy.
2. If still they deny the leave can we take any legal action against the company and the AVP hr.
what an employee can do about it.
Please help us or guide us.

she is entitled for maternity leave and she shold inform them in writing that she will proceed on maternity leave from so and so date.no leagl action required ,if company donot pay in lieu of maternity leave than u can approach labour court.

Dear Malik Sir,
In out concern we have 3 months maternity leave with 1/2 salary. But I heard in few other concerns its like full salary.
Is there any rules or policy for setting the salary during the maternity leave...??

your concern they are not following the law and as per law
the cash benefits as available to the women employee are as under---
1.leave with wages for 12 weeks it means full wages
2.a medical bonus of rs 250 if the employer does not provide free medical care to the women .
3.an additional leave with pay upto one month if the woman shows proof of illness due to pregnancy,delivery,miscarriage,or premature birth.
4.in case of miscarriage ,six weeks leave with pay from the date of miscarriage.
the amount of maternity benefit for six weeks to be paid in advance,but a proof of pregnancy is required.the amount due for subsequent period to be paid within 48 hrs of production of proof that women has delivered the child.

Hello Sir, Is this only for first delivery for the women? And what if the woman employee falls under ESI benefit..?

if women is under ESI THAN these benefits will be given as per ESI act to and employee.she will be entitle for 12 week leave and whe will get salary from ESI
as per their calculation .1 month leave if some problem in delivery or 6 weeks leave will also be given if any miscarriage.
