hi all members...
I am going to recruit new ITI candidates on company roll but in future I want to avoid union formation problem permenantly.
is it possible....How i overcome from this problem.

Hi,
Its just not possible. To form a union is a Constitutional right of the workers. They can form union and register it under the trade unions Act. Or they can join any existing union. In Maharashtra under M.R.T.U. and P.U.L.P. Act there are provisions regarding recognition of union by the employer. Some times to have a union of workers is beneficial to the employer. That way he doesn't have to have individual contracts with each worker for every small thing. He can enter in to an agreement with the union which would be binding on all the workers, even the ones who join later. So my advise is - take it positively.

Mr.sunil,
why are you thinking that formation of union is a problem!
If you can go through the history of big established companies, trade unions exist everywhere,which are positively supporting and binding to productivity.
hence, companies nowadays are voluntarily promoting union formations, forming their representatives and coming to a binding agreements and settlements that hep for the smooth working of the industry.

The formation of a union is only a problem if you let it be so. If you have the attitude of confrontation, you will have problems. Far better to work with the Unions and help each other toward a common goal. In the end, the company and Union are seeking similar outcomes.

Dear Sunil
I am giving this idea on the request in the Forum, implementation is purely depend upon your Management view and your view. Get a letter from the employees, that they are not belongs to any union and also they don't join in any union at their will. But this won't solve the purpose. But it gives moral fear to the workers that they have given some letter to the Management. If they want to start the Union, this letter may be treated as Fraudulent activity of the Management. But you can use this for Moral Fear among them.

Donot foresee strike in continuation to formation of trade union and regularisation of employment. Let us hope for the best and be positive that our workers will not indulge in illegal strikes. In order to avoid such happenings, I donot suggest to get any written mandate from the workers which may prove even more dangerous (such agreements are unfair labour practices on the part of employer from the point of view of Industrial Disputes Act also)Let us motivate the workers saying that they have been regularised and it is now with them to improve productivity and so on. I think that is enough. I feel so.
