Greetings Seniors,
Request you all to kindly let me know if we should pay bonus for an employee (relieved) whose gross monthly salary was Rs. 22000/-.
I understand (am not sure) that he is ineligible for bonus (FY 19) but the employee is insisting on it.

Here one important thing to be considered is that what is the bonus qualifying salary as per your company policy? Is it gross salary or basic and dearness allowance or basic alone.If you pay bonus on gross salary, naturally, this person is out of Bonus Act and you don't want to pay him bonus. At the same time, if you pay it on basic or basic plus DA only, then you have to take his Basic or Basic plus DA, as the case may be.
Again in respect of employees whose bonus qualifying salary exceeds Rs 7000 but not more than Rs 21000, if you take the minimum wages notified for calculation of bonus, then that has to be considered for deciding his bonus.

Respected Senior,
Thank you very much for taking your valuable time off.
We pay one month gross salary as bonus to serving employees. Recently, the Management had taken a decision to pay bonus for relieved employees according to Bonus Act.
Hence, I wanted to take expert advice before acting on it.
