Hi all, Is it possible for an employee be a member of ESIC if his/her wage is above 21000? If so, what will be the rate of contribution.

hi....Bino. The person those wage is under the 21000 or 21000 is come under the ESIC. The person who get the wage above the 21000 is not cover under the ESIC.

Other than hiking the wage ceiling to rs21,000/- , the ESIC board also allowed Employees to continue as Members even after their wages cross the Rs.21,000 threshold. Employees have the Option of maintaining membership of ESI after crossing the Wage ceiling.However, this is Optional.When did Employee concerned crossed ESI Wage ceiling, is it from 1st April-2017?

1. Sir, so far as I understand, coverage under ESI Act, 1948 is compulsory and restricted only upto coverage wage limit (Rs.21000/- as at present). I have not come across any amendment to the point that the same has been made optional for employees getting wages exceeding to above coverable limit.
2. Hope, the learned member, SriNath Sai Ram ji will supply and upload a copy of such notification for our guidance and up-dating, if possible.

Srinath ji, the concerned employee was a member in ESI till 2009. Now her salary exceed Rs. 21000. Is she able to enroll again in ESIC? Actually, I read in a news paper that, an employee can be a member in esic, even though his/her salary exceeds the limit. Hence I have this query.

Mr Binoy, you are right about News Paper report & ESI Press Release to that effect.But, the Employee in question who is out of ESI Coverage From 2009 to till date can not exercise this voluntary Option.
This option is Applicable for those already Covered under ESI or who have come in to ESI Coverage from 01/01/2017 consequent to increase in Wage Ceiling to Rs21,000/-
The Employer has no role in this.Employees concerned (Who go out of threshold of Rs21,000/- From 01/04/2017)have to approach respective ESI Local office to know about the modalities.

There was a proposal while enhancing ESI ceiling to Rs.21,000 that employees who are drawing salary >Rs.21,000 per month can opt for ESI Coverage. However, in amended ESI Act, 2017 this provision is not taken into consideration and coverage salary limit is kept upto and inclusive of Rs.21,000/-.

Sir, in the year 2017 there is no amendment in ESI Act, 1948. Last amendment in said Act, was held in the year 2010. However, through recent amendment changes have been made in ESI (Central) Rules, 1950 vide which wage ceiling has been enhanced to Rs.21000/- per month.
