Dear Ashama Aggarwal,
Greetings from Kritarth Team.
--- Your Query:- Is it Mandatory for every organization to get registered itself under these laws (Factory act or Shop and Establishment Act)? If not then which companies come under this category? Posted Yesterday.
--- Position: - Is the Organization / Establishment you are associated with, an Industrial Establishment or A Commercial Establishment of a Govt. Establishment or Dept. or NGO? If you specify, a specific/definite Clarification would be on its way to you.

Thanks for the reply.
It is a private company with around 20 employees and is an international software consulting company.
Also would like to know that if a company is MNC/ International, does this fact prevents them to follow these laws?

---Dear Ashama Aggarwal
--- The Laws of the Land apply to one and all business activities within the shores of India, a Sovereign Nation, as they do in comity of Nations, anywhere. Is your "Private" Company not registered under the Companies Act 1956 as a Body Corporate/Legal Entity ? Does your Co operate Bank A/c for payable & receivables ? ave you yourself been not issued a Proper Employment /Appointment Letter ?Do you not avail PF, Gratuity, ESI privileges plus Leave, Off or National Holidays? There are host of Multinationals operating in India like many India Companies operating Off-shore.
In fact, your Employer is Legally liable to Implement the Newly enacted Law namely "Sexual Harassment of Woman at Workplace (Prevention, Prohibition & Redressal) Act 2013 and the Rules framed there under and gazetted on 9 Dec 2013 as stipulated in Section 19 properly and faithfully failing which s/he is liable to Penalties including Fine of up to Rs. 50,000/- and also Cancellation of Business License/Permission.
To conclude, please let the Employer take note that "Ignorance of Laws is No Bliss" . We are here to help
