Dear All,
This is regarding Salary Process in my company, we adhere to take few steps to improvise the regular process
Our current Attendance cycle is from (1st to 30th of month) but due to our attendance maintenance in remote sites we won't able to collect all the details related to attendance & other reimbursements till end of month due to which salary got delayed from 7th of month till 10th of month or 12th day of month, so now we want to consider the attendance from (26th of proceeding month to 25th of current month) thus the salary shall be released on 7th day of every month.
[B]Since we are practicing the same process with next month salary, so the staff will be released the salary of 25days in the same month and from next month the same will maintained as attendance cycle (26th of proceeding month to 25th of current month).
So in this case please suggest; are we breaching some law like (labor law or min wages etc.) by paying 25 days salary to staff in 1st month or it can be done as per discretion by management.
I require your esteem suggestions...
Looking for your response.
Regards

That is fine. If for the first month you are paying salary of 25 days then in the next month pay the salary of additional 5 days as arrears

The best solution to manage salaries and attendance etc. for the employees is to go for an advanced HR or Payroll software like SaralPayroll.
By, utilizing a payroll software you need to just enter the required data and information for the employee etc. and the whole other things like leave, salary, deductions. payroll, attendance etc. will be processed by the software itself.

No, you are wrong in your approach
Under the requirements of payment of wages act, you are required to pay salary for the calander month. You can not decide wage periods at your discretion.
At the same time, payment of salary by 7th of the next month (10th for companies with more than 1000 employees in a particular establishment).
What you can do, is to go ahead and consider attendance till 25th and assume that people will be present during the remaining working days of the calendar month. If someone is absent, then you can deduct the excess amount from salary of the next month.

Dear
I agree with Mr. Banerjee's views. You should pay for full calendar month by due date. However any adjustment, if any, can be made during the next month payment. Special cases like new joinee or who have resigned may be paid after receiving full report and attendance site may be directed to send report immediately to decide payment of salary/wages.
In this way, in my opinion, there will be no violation of law. Employees should be paid on or before due date.
