hello everyone,
i was working as graphic designer in non-gov area, some event management services in bangalore. my salary was 25k/mnth and i am from maharashtratra. here issue is, i joined that company in july12 and left that company in oct12 (due some management issues). so, my working period was for 3 months. they cut my tds time to time from my salary, its obvious.
i want know, will that my tds return from company or by tax dept, legally because it was within a financial year?
here now, i am still unemployed.
so, whts the procedure to get back tds?

For the salary of Rs. 25K Per month then if there is wise salary breakups then you will not fall under TDS bracket. Thant too you joined in the month of July. So obviously not applicable for your salary. Even if there is Deduction then there should be very small amount per month which will not exceed Rs. 200/-PM.
As per Income tax rules If there is any TDS then organisations will have to remit the same to IT department & at end of the fy. You might get TDS certificate/Form 16 in the month of July or August 2013 from the company. You should claim the same from IT department. Now company is nomore involved into repayment.

As others said U R not taxable as of now for 2012-13 Fin.year (assuming there are no other income during this year). So U can claim refund of TDS. To be safer, obtain Form-16, from your erstwhile employer now itself and based on which U prepare/file your IT return before 31.7.2013 and claim refund from IT Dept.) (if they had already remitted your TDS to Govt, but in case they have not remitted by chance till today you can obtain refund from them itself so first contact them to know the position).

Hello Shayli Company can not refund your TDS, you can claim refund in your Income Tax return. You have to file Income Tax Return after 31 March 2013 for the financial year 2012-13.
