Dear All,
I'm facing a prbolem regarding the Earned Leave Benefits.
Our Managing Director had resigned from the Organisation Last Month.
He was working here for the past 10years. Upto now he hasn't taken the Leave as per record and now he's asking abt the EL to be paid for the past 10yrs.
I'm asking is there any procedure of paying so long leave balanced.
One thing more upto yet we didn't pay leave to now to any employee.
Upto mine knowdlege the leave could be encashed upto one year
Now pls suggest me wht shld I do as he's asking to prepare his details.

Is there any policy of your company which express how many EL one can avail in a year ?
What is the accumalation limit ?
if it is not then according to law you have to calculate 1 EL for every 20 days so it will come to 18 days & 18*10 Years = 180 days.
so you have to give encashment of 180 days.

Thanks for the reply, it'll help me to look over the matter.
Well we provide 20days EL for the person working more than 5yrs.
I'll discuss this with the management.

Dear All,
please look into below points
First 1 day EL is for each 20 days employee worked and not 20 days remain on roll.
second you can not grant 15 days to the employees below 5 years service in one organization and 20 days for employees working for more than 5 year in the same organization. A manager can not be granted less leave for same working days of last year because he joined the organization 2 years back whereas you are granting more leave to officer under him because he is with the organization for last 6 years. (Total work experience may also be more of manager)

Sunita,
The leave encashment is done as per the company's policy. The leave encashment is no doubt paid only for one year; pertaining to that year when he resigned, because there are policies is some companies that the leave are not carried forward to next year. When the financial year is finshed the leaves will be paid to that year. So review the company policies and then make the payment with respect to his basic salary.

Terms and conditions of appointments are decided by the Board and approved by the General Body. Check what has been approved by the Board. Managing Directors remunerations are goverend by Compqanies Act as well
Rather checking in employment law, check what was approved by the GeneralBody.
One more clue I will give
Does his remuneration allow Leave Travel allowance?
If yes, has he claimed this every year?
If he has claimed this every year, he sure, must have proceeded on leave.
He can not now claim that he has not availed leave
