Hii I have a query, if anyone not submitted the notice period, then can notice period recovery amount be deducted in bonus?
From India, Kolkata
The legality of deduction from bonus will depend on whether the bonus is statutory bonus or not. If it is a statutory bonus, no amount by way of notice pay shall be deducted from it. After all, a person coming under the purview of Payment of Bonus Act, will be a workman under the scope of Industrial Disputes Act. Then the question of notice pay itself will not arise.

Whether or not a notice period amount can be deducted from a bonus typically depends on the terms outlined in the employment contract or company policy. In many cases, the notice period and bonus are considered separate entities, each governed by its own set of rules.

However, some companies may have policies or clauses in their contracts that allow them to deduct the notice period amount from the bonus if an employee fails to provide the required notice before resigning. This is often done to ensure that employees fulfill their contractual obligations and to mitigate any inconvenience caused by their sudden departure.

It's important for both employers and employees to carefully review the terms of their employment contracts and any relevant company policies to understand their rights and obligations regarding notice periods and bonuses. If there are any questions or concerns, it's advisable to seek clarification from HR or legal professionals.
