The employee expired in April 2021, but his wife has not received EDLI payment yet. She contacted company officials, who said we completed all formalities and submitted the EDLI claim immediately to the PF office. However, due to time-to-time changes of PF officials, the claim has not been settled by the PF office. Company officials say we submitted all papers demanded by PF officials from time to time.
Employee wife file grievance in pf office,pf officials says company not submitted papers which required for edli payment.

There is provision of 12 percent interest given to employee if edli payment not settled within 15 days after employee dies.but till date she not received EDLI payment.
I want help what can she do .and want format of notice to send company officials and pf officials for edli payment and interest.

Hi, This looks as unusual delay.

If the nominee is having the copy of all documents submitted including EDLI form then better contact respective PF office PRO and check the status. Also check with the Employer for the proof of EDLI form submission. Alternatively the Nominee can make a appeal before PF Adalat.

Hello Mr. Pradeep Patil,

EPFO directed everyone to file e-nomination through the Unified Member Portal, which all of us including HR Professionals, took it casually. The process is/was to simplify the life of the family member of the employees after their demise. Hope the e-nomination was got done by the member. Now since you said the documents are not received by the EPFO, then their might be two genuine cases either the documents were incomplete of the EPFO has actually lost the documents. Documents are a lot of the times misplaced by the EPFO. You might have guided the family to get a receiving of the documents submitted at the EPFO. If not, please arrange to submit the complete set of documents at the earliest since EPFO is saying that they have not received the documents. If yes, please show EPFO the receiving and ask them to provide the EDLI benefits at the earliest. In future please make a record of every visit and if no one listens to your grievance, please complain to your SS (EPFO) or Account Officer (EPFO).

Please note that following documents are mandatory to be submitted for claiming the EDLI benefits and If the employee dies whilst being a member of EDLI, the scheme benefits would be payable to the nominee or legal heirs of the employee. To claim the benefit under the scheme, the following steps should be followed –
- The claimee/claimant should fill up and submit Form 5 IF.
- The form should be signed as well as certified by the employer stating that the employee was an active member of the EPF scheme. If, however, there is no employer or if the employer is not available, the form needs to be attested by authorized individuals who can be any of the following –

The local MLA or MP
Bank manager where the employee’s bank account has been maintained
Magistrate
A gazetted officer
A post-master or sub-postmaster
Member of EPF, CBT or any regional committee
Form 20 to withdraw the employee’s EPF, Form 10C/D for claiming benefits from all the employee benefit schemes and other documents should be submitted to the regional EPF Commissioners Office
The submitted documents would be verified by the EPF commissioner and the claim would be paid within 30 days.
If the claim is delayed, interest would be payable on the delayed claim. The interest would be calculated @12% per annum for each day of delay till the date of actual payment of the claim.

To make a claim, besides the specified forms, the following documents would have to be submitted by the nominee or the legal heir of the employee –
Death certificate of the employee
Succession certificate if the legal heir is making the claim
Guardianship certificate if the claim is being made on behalf of a minor by an individual who is not the natural guardian of the minor
Copy of the cancelled cheque of the bank account where the claim should be credited
