We are a seasonal manufacturing company, situated at Gujarat. I would like to get a help on followings.

1. How many hours of overtime is permitted per hours, week, month or quarter.
2. Can we ask employees to do overtime during the season beyond the permitted hours.
3. What is employee is ready to do overtime beyond the permitted hours.
4. Can female worker do overtime?
5. Can female worker do night shift?
6. Is there any provision available to allow employee to do extra working hours beyond the permitted hours?

The queries are answered below at seriatim:
1: Following the Corona outbreak, the Gujarat Government had relaxed the Factories Act requirements regarding working conditions in factories there. It is not known whether the relaxed rules are still there or the status quo ante has been restored. Pl check it.
2. If the employees are permitted to do overtime during the season beyond the allowed hours, it may result in the prosecution of the Factory occupier and manager for violation of the Act, if it comes to the knowledge of the Factories Inspector.
3. Rediness or willingness of the employees to do overtime beyond the permitted hours is of no help, and is not an excuse to violate the law

5. Female workers can be put on the night shift, subject to the safeguards laid down by the State Government.
