Greetings:

If a Union is not obeying tripartite settlement. Please suggest a procedure for how to file a complaint under the ID Act for breach of settlement. Please suggest a suitable draft. Is any other remedy available with the employer?

Is the Union not following the settlement a minority union or a party to the settlement? Since it is a settlement u/s 12(3) of ID Act, which is equal to an award, it would be binding on all the workers without reference to the Union under which the workers fall. In National Engineering Industries Ltd Vs State (2000 Lab.I.C.260 SC) it was held that this kind of settlement will be binding on all the workmen even if the minority union has objected to it. You cannot scan the settlement in bits and pieces and hold some parts good and acceptable and others bad. Therefore, you can initiate disciplinary action against the workmen who do not follow the settlement. You can also involve the appropriate authority in it.
