Dear HR Experts, Pl suggest...
If an employee has worked in a company for 4 years and 3 months, and after that, the management of the company asks him to put up his resign and the employee resigns, then in that case, will the employee get gratuity or not?

Hi Gratuity will be applicable only if the employee completes 5 years of contineous service and hence in this case employee not eligible for Gratuity.

In following exceptional cases as per labor laws, Employee is liable to get gratuity benefits:

Disability with 100%
Sauter down the company
Termination of employment.
Ask to resign by Employer.
Death

But I have some doubt on " Ask to resign by Employer " hence I want to clarification on it.

Would request to all professionals, Pl do clear my doubt.
