Can any employer ask a candidate post releasing offer to sign an undertaking that asks the candidate to forfeit any offer already taken or not to look out for new opportunities in the market

Hi,

Yes Employer can demand to sign such undertaking. It is Employer's call ! But while employees who signed Training Agreement /Indemnity Bond itself are absconding without any information to employer you cannot expect such undertaking will bind the candidate who just accepted the offer letter. Also you cannot expect the candidate will honor the same after signing such undertaking.

Alternatively you can issue offer letter without mentioning the salary or where ever possible do not issue offer letter and issue directly appointment letter on the day of joining.

Though I agree with your suggestion, on what basis would a person resign from his current employment without any written assurance of offer in hand? I have myself tried not mentioning the salary in offer letter and it has worked.

Hi,

Convincing the candidates with oral offer is the the biggest challenge ! But no other go. Most of the times candidates got offer use it as a trump card to bargain with other employer and succeed with that.

I suggest that when you interview a person and finally expect him to accept your offer, keep the offer open for a period of one week or 10 days by the date which he should sign and accept the preliminary office letter. Normally company release such a letter to the employee that in the middle of the letter they mention this offer is open for acceptance before a date_______, failing which the offer stand cancelled and no claim of guaranteeing you to give you an employment in the company. This original letter should be surrendered which acceptance of offer thereby an appointment letter will be issued to you forthwith on the date of joining in the company with bio-metric record will created immeditaely.
