The principle of equal pay for equal work applies to contract labor when they are engaged in works or operations alongside regular workmen of the Principal Employer.

The principle of equal pay for equal work, irrespective of gender, applies when both sexes are employed as contract labor in the work of the establishment.

To add to the opinions on the record, reference is invited to the provision in the Contract Labour Central Rules. Rule 25(2)(v)(a) states that in cases where the workmen employed by the contractor perform the same or similar kind of work as the workmen directly employed by the principal employer of the establishment, the wage rates, holidays, hours of work, and other conditions of service of the workmen of the contractor shall be the same as applicable to the workmen directly employed by the principal employer of the establishment on the same or similar kind of work. Similar provisions would also exist in the State Rules. Therefore, the liability is not only for the payment of the same wages but also with respect to all other service conditions.
