We are in Security Business. Security Guards often work for 7 days a week and they are paid weekly off for working 7 days a week.
If we add weekly off with wages then many of our guards salary is exceeding Rs. 21,000 per month and hence ESIC is not applicable to them. Please note, we are deducting ESIC on weekly off and overtime too and depositing it regularly. My opinion is that OT is not considered for the purpose of coverage because it is not fixed wages, but in our case weekly off is fixed and paid every month along with regular wages for 26/27 days.
My query is Whether Weekly Off to be considered as part of wages for the purpose of ESIC coverage?

Security guards are getting weekly off payment or reliever charges from employer, for the work carried out by them on a weekly off day. Hence the payment received on this account, shall fall into the definition of "wages/salaries" and hence this amount need to be considered for the purpose of payment to ESIC.
