Hello Everyone,
One of our employee got injured in an accident and ESIC Doctor instructed to have 30 days of Bed Rest.
What benefits one can claim via EPF or ESIC for the duration of Rest Period ?
What are the procedures ?

Hi..
For accident employer needs to sybmit Form 12 accident report through online to ESIC. After discharge from ESI hospital take all the documents i.e., Admit form, discharge summary and rest suggested by docter. These all documents have to be shown in IP(Employee) registered dispensary and the dispensary doctor will issue leave certificate in duplicte which original has to be submitted to ESI branch office and 2nd copy to be filed by the employer.
At ESI branch office employer needs to submit wage register, attendance register, witness statement if accident occurred in factory premises.
The employee will get leave till doctors certify the employee was fit to join duty.

The above is applicable only if the accident ha happened during the course of employment. In the case of accidents not related to employment, the employer cannot upload form 12. Obviously, if the IP will get medical benefits. The days will be marked as ESI leave and that will be unpaid leave. If the accident has taken place during benefit period, (ie, if he employee has been in service during October 2017 and March 2018 with at least 78 days of working in this period, he will get sickness benefit (cash benefit for these 30 days from ESI Corporation which is approximately 70% of the daily rate of wages) because the contribution period corresponding to the current benefit period of January 2019 to June 2019 is 1st Oct 2017 to 31st March 2019.
If he was not in employment during the above mentioned period he will not get the cash benefit.
In the case of employment injury the above conditions regarding contribution and benefit period will not apply. He will get average wage for 30 days.
