One of my machine operators met a major accident on the company premises, and ESIC has referred him to a government hospital. What kind of benefits does ESIC grant if he is found disabled? Also, please inform me about the percentage of the amount of leave that is compensated by ESIC.

Dear Member,

The injured employee will be entitled to the following benefits in cash provided the accident report is submitted by the employer on time and the case is admitted as an employment injury by the ESIC Branch Office:

1. Temporary Disablement Benefit during the period the employee is temporarily incapacitated due to such an accident as may be certified by an ESI dispensary/hospital.
2. Permanent Disablement Benefit (after being declared fit). Such permanent disablement is decided by the medical board as constituted by ESIC under the said Act based on the loss of earning capacity due to such an accident.

In addition, medical facilities can be availed by the said employee. For rates of such cash benefits, kindly refer to Rule 57 of ESI (Central) Rules, 1952.

Dear Mr. Pulkit,

The injured employee will be entitled to a disability pension after receiving the certificate from the ESIC-Medical board. The pension amount will depend entirely on the percentage of disability.

Firstly, please submit the accident report to your local office immediately in the required format. Seek guidance from your local office for the next steps. For information on cash benefit rates, please refer to Rule 57 of the ESI (Central) Rules, 1952.

Can you tell me if ESIC will consider 100% of the leave for payment or reduce the percentage? One of my friends told me that they will only consider 70% to 80% of the leave amount. The process is the same for accidental cases. Please guide me.

Hi Pulkit,

It totally depends on ESIC - Local office manager and accident reports submitted by yourself/company. If the accident is on the premises, the percentage is up to 80-90%, and if the accident is off the premises, the percentage is up to 60%.

There was an accident in our factory premises, and I have also submitted the accident report to the local office. The individual has lost seven fingers on both hands due to a paper-cutting machine. In terms of disability, how much pension will be considered?

Dear Kiran, if he is a Esic Insured employees then first admit in esic hospital. if he is not a esic insured person then you have to admit him any local hospital.. Regards pulkit
