We have a pantry boy for cleaning purpose who is on the payroll of our sister concern. Now, since his full services are being consumed by our office and our sister concern raises a bill for the services provided by the pantry boy to our Company, who would be liable for the deduction of PF. Further, the point to be noted is that the sister concern's main business is no where related to outsourcing such services.

Hi, The principal employer is liable to ensure PF deduction. As a Principal employer you should ensure PF deduction and payment. Payments due to the contractor (sister concern) should be made only after verifying that the statutory PF payments have been made to EPFO. This can be verified either directly from the EPFO portal or insisting on a payment receipt obtained by the contractor from the EPFO portal while making payment.
