Hi,
It depends on the terms and conditions of employment terms. If your Company policy permits either 2 months notice or 2 months gross pay in lieu of notice then you can consider proper relieving after recovering 2 months pay from his settlement or after collecting separate demand draft. Its basically based on call of the employer. If employer is ok with One month pay then you can consider one month pay. Other option is relieving him with relieving order mentioning that Notice period is not served. So you have more options. whether his immediate relief will result in loss of work production /need his presence till find replacement etc - based on his role in the Company please decide.
