Kindly clarify whether gratuity is applicable under below Scenario"
When an employee was employed by contractor for a period 3 years and the contract get renewed with another contractor who observes the existing employees without break in service from the commencement of contract. When the employee is getting releived from his new employement after completion of 4 years and 8 months working continously at the same place of work, whether he is eligible for payment of gratuity and who will responsible for the payment of liability for the previous completion of service. Is it is a liability of the principal employer, since new employer issued appointment letter from Date of commencement of new contract.
