The company that I'm working for has a new employee who has joined 3 months ago. Her salary is above Rs.15000.
Does she have the option of choosing not to opt the EPF and ESIC deduction. If so what measures needs to be taken as a HR to effect this?

An employee whose salary is above Rs.15000/month can be exempted from Provident fund provided she do not have an active PF account. That means if she had PF account in her earlier company and if that is not closed, in such case she is eligible to get PF in your company also. You have to get filled and signed the Form No.11 from that employee. If in Form 11 she declare that she do not have an active PF account, then she can be exclude from PF.
If her salary is above Rs.21000/ month, she can be excluded from ESIC.
