Guys just going through an order of our Supreme Court, which I think worth to share with you! In Sanjay Jain Vs. National Aviation Company of India Ltd. it has been held that it is right of an employee to resign from his/her job if he/she does not want further to continue with the employment unless there is any stipulation rule or clause in the terms and conditions of the appointment letter or any disciplinary proceeding is pending against him/her.
Further the Employer cannot force the Employee to work and hold his/her release documents.
So guys please read all the clause of your appointment letter especially the termination clause and move accordingly.
