Dear JudeGR, But our company HR have calculated the gratuity only on 5 years because he says if employee complete 5 years 6 months and 13 days than it will be considered only 5 years in gratuity?

Try to consult with the representatives at labour commissioner office to which that company belongs to.

The company needs to follow rules which say the time period of over six months or more is considered as one year.
Since person has complete 5 years and 6 months +13 days,the time period for gratuity becomes 6.
