Hello All...
I am working in a software company, here one of our employee leave the job without serving the notice period. He was working with us from last 6 months only, and now suddenly give the resignation on 5th of June and mention that he will not be able to come from 9th of June, and he did the same. Can you please suggest me a mail format for this situation.....

You need to disclose more particulars like notice period, if so the duration, also whether the employee had any leave to his credit, did he offer to pay for the remaining notice period, dues payable to him, any property retained by him etc before drafting a meaningful mail for the purpose.

The notice period is 30 days, if employee unable to serve the notice period of 30 days he have to pay 1 month of his basic salary as notice payout. and now we have decided to stop his last months salary as notice payout. Is it relevant?

It would be helpful to share if the person was on probation, as companies have different rules set regarding the notice period for team members while on probation. Assuming the notice period be 15 days, how many leave the team members had in his leave account?? Talking about not releasing his salary, it solely depends on the clause and the policies while signed, if mentions that the salary and the F&F would be null and void if a person absconds, then yes, it could be a all together a different approach.
Suggestive, a call to the employee asking about his act would not only help brand our self better but would reflect the (working culture), there could be ample reasons of the person absconding. It could be something within the company - or the manager that would have indirectly/directly forced him for his act as he being fairly new.

You can reply to him stating that "As you have failed to serve the notice period of one month, the resignation tendered by you is not accepted. Since you have not been attending duties from 9th June without any intimation, the same tantamount to absconding from employment and accordingly action is being taken. "

You can not do much in the matter except making some communication. You send him a letter saying that his resignation is not accepted as it is not proper, if he is under the terms of notice.

Dear Member,
I think nothing but a show cause notice you have to give through mail. Format of show cause notice is given in bare act.
1.Show Cause Notice : details of absenteeism with reference to his appointment letter clause in which Notice period mentioned. This letter should be under registered ad on address provided by him/her
2. No experience letter , salary till he give satisfactory reply personally or by written letter.
