Dear seniors, Is maternity benefit will come if any female employee adopt 3 month baby can we provide maternity benefit for that employee is there any section for this in maternity benefit please clarify my doubt .

Adoption is not maternity, it is not case of 'child-birth'. Hence she is not entitled to any maternity benefit.

Adopting a 3-month child is a great service to humanity. Weeing, feeding and taking care of such a baby is a full-time job, and the expenses involved are obvious. True it's not a case of 'child birth' and hence, by Srikant's perception, doesn't qualify for maternity benefit.Again, I am ignorant of what the Indian Labor Law says on the issue; but purely on humanitarian and rational grounds, the staff must be provided the benefits.
Not only will this make for a happy family, but you will have the most committed employee on your team.

A good News for you that your wife can have the facility.
As per the new ammendment to Maternity Benefit (Amendment) Act 2017 ("MB Amendment Act") The Ministry of Labour and Employment, Government of India ("Ministry of Labour") vide Official Gazette notification dated 31 March 2017 has sanctioned certain assistance for adopting Mother.
• Maternity leave for adoptive and commissioning mothers: The MB Amendment Act extends certain benefits to adoptive mothers as well and provides that every woman who adopts a child shall be entitled to 12 weeks of maternity leave, from the date of adoption.
You can call your employer to extend facility as extended by the statute. To have through information contact local labour department and sought assistance, incase your employer rules out the faciity under MB Act.

Sec 5(4): A woman who legally adopts a child below the age of 3 months, shall be entitled to
maternity benefit for a period of 12 weeks from the date the child is handed over to her.
If she has adopted child who was less than 3 month old, she will be entitled to 12 weeks maternity leave.
