Hi,
I am working in well known company since last 5 Year, During this period My employer has not given me Maternity Benefit.
Now I want to leave this organization Can i claim for Maternity Benefit ???

Dear Friend, All pregnant women are eligible to get maternity leave before or after pregnancy on producing documents. Similarly men are liable to get paternity leave. Daljeet Singh 7894187756

Actually I have join this organization In 2007. And In 2010 I gave the Maternity Leave application at that time mgt told me that as per rule of our company we are giving only Leave without pay. At that time I want to conti. with this org. So I not say anything and accept decision. But now after 2 to 3 years can i apply for the same??

Please note that maternity leave is not something up to the choice of employer. This is a protected with a statute and refer the law at http://labour.nic.in
You were eligible for maternity benefit and may be your management denied the claim

Dear Member,
If you have proof of having applied for Maternity Benefit at the time it was due, you can file your claim again with the management. If management denies you can approach the appropriate labour law enforcing agencies (ALC - through Labor Union, LEO of the Area) or the labor union to which you are a member. The benefit under the Act is payable and it is not upto the will and choice of management whether to pay or not.
