Dear Seniors, One employee has the 706 Days LOP. Hence, we want calculate gratuity eligible years. So, 706 days dividable for 26days or 30 Days. Urgent please

it need to be calculated year wise and to be divided by 26 always. you may be taking 706 LOP's during his/her whole service record, but it need to be segregated as per year.

in each Year, Employees should have worked for a Minimum 240 days.The year in which, Employee does not have a minimum 240 days, Gratuity can be withheld only for that particular year.But, before resorting to this, Employer has to issue Show Cause Notice to the Employee calling for his explanation as to why Gratuity Amount should not be forfeited for the years in which he has not worked for a minimum of 240 days.
