This is for your information that if employees have not completed his 5 years, he is eligible for gratuity on below Condition: If an employee completed his 4 years in service and has completed 240 days in the 5th year then he is entitled for 5 years gratuity.

Sir,
You are not eligible for gratuity. Those who have completed 5 years of continuous service are only entitled to get gratuity. The judgement of Madras High Court making 4 years 240 days service eligible for gratuity will only apply to people in Tamilnadu only.

Dear sir I don’t think so, that will apply to T N only. It applies to all place where this act apply. In present case he is eligible for gratuity if he has worked 240 days in each year. Pranesh

Dear All, If worked for 240 days in each year for 4 years & 8 months in 5th year he is entitle for gratuity as per Gratuity Act.

The eligibility will depend on days one is paid in the fifth year. If the org works for 5 days a week then completing 190 days in the fifth year will make him eligible to claim gratuity. If the org works for 6 days a week then completing 240 days in the fifth year will make him eligible to claim gratuity.

We are closing our garment industries at Chennai at the end of June 2017. Please send us the closure formalities in tamil and english for us to display and government letters if any please send
Also if the employee has not serviced for 5 years in our unit, shall we pay gratuity for the services rendered for 4 years and 6 months onwards

What is this 190 and 240 days exactly? You mean we have to only take into account only 23 days each month for a 5-day week or does it mean that a person who completes 6 months and 7 days as per the calendar is deemed to have completed one full year?
