can u pls tell me what all documents are required from the employee if he is absconding for the period of 3 months without intimation & coming back after 3 months with a medical certificate - what actions can be taken against him?

Disciplinary Action. Verify the medical Certificate. do a cross check of his health from your side.. after that based on the outcome you can decide,,,,

Thats all you can do what Peer Saab as mentioned. Do all required cross checking and based on that take him/her back if the reason is really genuine. And i think you have to take that employee back only as fresh joinee and cant continue his last services. Hope this is of some use for you.

1st of all u shld not allow any employee to come in this way ..
it all depends on uu presetly my advice is give him the reliving and experience leeter and ask him to leave .........
But fornext ... do follow this if any employee is adsent for office for one week with out notice to HR or manager send a letter though post (regis) to hisperminent address stating that if u dont come we treat this as vilating the rules and will terminate you . do respond before 7 working days if not collect the termination letters(before that try to call to the no that he has given in the joining form)
if there is no responce for the 1st leeter woth in 7 working days send the second one and after that send the phot copis of the letter to the address not the experience or reliving the TERMINATION LETTERS

What were you doing for three months.....were you waiting for him to join? you should have then only tried to contact him on the address given by him. You could have also sent him a telegram to that effect. And if he would have not have made any communication then you could have easily delared him absconding.
Now in present case you can do a verification of the medical records and issue him a warning letter stating as to why no communication was made from him. You cannot expell him from office as you have not prepared any background for the same. From next time take proactive measures. Now legally you cannot throw him out of job if his medical certificates are correct. issue him a soft warning letter. Discuss with your superior what specific action you can take as you best know the entire story.

Please check what is your offer letter says. Usually every offer letter carries one clause i.e. if xyz is absent from duty for consecutive x no of days without any information it will be treated as termination etc.
If it is there then you should consider him as fresh appointment if the position is available in your organization. OF COURSE DO A THOROUGH BACK GROUND CHECK. ASK HIM TO PROVIDE ALL THE RELEVANT DOCUMENTS, THE DOCTORS NO EVERYTHING THAT SUFFICE YOUR CONCERNS. Because in todays world it is really amazing that he couldn't inform you about his absents for 3months. personally I cannot justify it.
