I have an employee in Bombay who had a leg injury in June 2016. From then till now he is on medical leave. He only comes to work 2-3 days a week. Can I know what the employment act is like on this. Should I deduct his salary? Is there a hospitalisation leave. if So how many days? How do I handle this? Can someone please help. Thanks

There is no such medical leave under Factories Act or Shops and Commercial Establishments Act. However, if the latter Act is applicable to you, you can give a maximum of 12 days sick leave. But no leave is a right of any employee and therefore, if you doubt the genuineness of the leave, don't grant any leave but deduct salary.
Nothing above said will be applicable if the injury was sustained during the course of employment. In such scenario, you have to give him leave with pay till he is fit to work. Normally, in such occasions, the company will insist the employee to get medical certificate from the company medical officer only.
