Hello Everyone,
Greetings!
If company registered in Factory Act 1948 & company wants to engage housekeeping contractor which is registered under Shops & Establishment, should contractor follow factory minimum wages as per principle employer rates or it should as per Shops & Establishment.

Every employee or contract employee working in a factory.....have to follow principle employee minimum wages.
if in case s&e minimum wage is more than factory minimum wage, then the employee should be provided with higher end.

Dear Sir,
If the Housekeeping firm has registered under Shop & establishment act and taken a contract in factory,
If His Janitors are regularly employed in factory , MW of Factory will prevail.
If the people are on rotation , may be changed , MW of S&E will prevail.
At last & in nut shell , MW of Factory should prevail. It is my opinion. We should think on behalf of HR purview as well as from side of manager of factory also.

Hi All
Payment of Minimum Wages depends on the nature of Industry in which contract labour is engaged even if the Contractor could have registered under S & Estt Act (Normally the office of the Contractor will be registered under the S & Estt Act & not the place where he may engage his labour).
