If an teacher on leave from 04/10/2015 from 15/10/2015. He apply CL from 04/10/2015 to 10/10/2015, 11/10/15 is off day and 12/10/2015 is holiday and his CL is balance is nil, from 13/10/2015 to 15/10/2015 treated as Absent. My quarry is 11/10/2015 and 12/10/2015 are treated as Absent or Paid holiday.

Dear Friend,

Leave rule is simple, just go through this procedure :

Casual Leave : Any leave..prefix and suffix if holidays the middle of the leave can be availed as CL, Sundays can be treated as permission, if Saturdays (for a five working days of the organisation) monday can be availed as casual leave with Prefix Saturday and Sunday as permissions(being declared leaves), any important holidays can be availed with the casual leave.

Earned Leave : Only prefix and suffix can be availed no other holidays in between can be treated as permissions .. all that should be treated as earned leave.

Medical Leave : No permissions, upto the date of submitting fitness certificate, need be regularised according to the organisation rules and regulation or as per procedure in vogue.

Sick Leave : As per procedure in vogue, no permissions.

bereavement leave : No permissions, according to the procedure in vogue, rest with the authority who is sanctioning leave or organisational procedures.

Hospital leave : Exceptional cases in government services in particular armed forces/subordinate forces.

Thus in this case you cannot treat leave in continuation as casual leave all that be treated or should be regularised.

So where is the confusion if the application is from 4th Oct to 15th Oct then whatever EL/Pl available balance has to be adjusted and rest days to be treated as LWP including 11th & 12th Oct.
If the employee has applied Leave from 4th Oct to 10th Oct, but has joined on 16th Oct, then EL/PL to be counted till 10th Oct. and from 13th Oct to 15th Oct it will be LWP i.e. 11th & 12th Oct. will be paid Leaves.
