I used to work in Accenture and have been forcefully asked to resign after not clearing my performance improvement plan. I was put in PIP deliberately as result of conspiracy against me. Many of the top management folks were against me and despite their being improvement in my performance, they forcefully asked me to Quit. I had serious grievances raised to the HR against some of the management folks but they refused to listen to me. They have paid me 2 months salary but I am absolutely disgusted with the fact that they ousted me with a plan and it was done intentionally, as I stood against some of the management people.
Now when I am trying to reach the TOP management to intervene and provide me with justice, nobody is willing to co-operate.
Please suggest if I have an option of filing legal case against the company.

Dear Manish ji,
On what ground you wish to file a legal case against the company? Taking the resignation forcefully?
The court will ask you, being educated how you sign the document and what you did after signing it. Have you approach the police with complaint of taking signature forcibly? Do you have any evidence to prove it?
You have no chance according to me to win legal battle, according to my view.
Learned member Mr. Nathrao rightly advised you. Forget and forgive every thing and start new way.

The reason why I have resentment against the Accenture management is because one of the top management person had told me categorically like 4 months in advance that you would be put in PIP and eventually asked to leave the organisation and that thing turned out to be true which clearly shows it was orchestrated well in advance.

My immediate boss never liked me and was always against me. I was the Team lead of my process and had made my project green on all the parameters despite that they said you have not cleared the PIP as it was pre-decided they would oust me from my position.

As things were getting personal during my PIP, I had tried to raise the concerns to the Service delivery Lead of our project and wrote him 3 emails for the same but he refused to acknowledge, which clearly suggest even he was influence by my immediate supervisor against me. Talking about the HR's they are the bell boy for the upper management, if you try to speak anything against management or lodge a complaint with HR they would be the first one to leak the information to the management.

The reason why I had to resign because if I had not resigned they would have terminated me, as a result I would not have been able to show my accenture experience and it would have been difficult for me to explain the gap when i would have applied for another job.

The only unfortunate thing here is that i don't have any proof , all i know is that my process was green, my team was happy with me and I had tried to raise the concern to the service delivery lead but to no avail.

Do you think if I file a case, I can oblige the company to produce all the documents in court related to my performance and also the fact that 3 emails that i wrote to the service delivery lead were unanswered. My team leader score card was better than other team lead's in the same project, my SLA's were green, my daily metrics were green. It is just that I had spoken against many of the management folks for their wrong doing they did not want me in the process, as I had become a thorn in their side. Some of those whom i had complaint against were very good friends of the Service deliver lead who eventually called the shots. Rest is history.

So my question to you, should i take the risk of pursuing a case against them despite the fact the odds are not in my favor and what are the risks attached if i do plan to file a legal case.

You should have asked them to terminate you instead of resigning and then contested the termination on grounds of natural justice. But, gentleman, let me assure you that once a management decides on separation, it's better to move on in life. The reason am stating this is because the court process does not end in one court. And the organisation has the financial muscle to prolong the case and frustrate you by appealing in every court of appeal till the Supreme Court. You may win the case there, but at what cost. Recently, the Supreme Court gave a judgement in favour of a former professor of IIM, Bangalore. Sometime in the late 70's, he had rubbed the management on the wrong side and was terminated. The first court where he appealed declared his termination void. IIM, Bangalore got a stay order on the verdict and in their own leisurely pace went for appeal. This gentleman lost his livelihood and his ego did not permit him to move on. He was a Ph D mind you. He won the case in every stage of appeal and won. But the final verdict came after some 36 or 37 years from the Supreme Court. And the court gave a judgement to give him a percentage of his back wages since in any case he was not working. And the judgement also said that he cannot now go back to work since he has already crossed the age of superannuation. His family went through all the turmoil and missed out on the comforts what their peers were enjoying.

We are not living in a wonderland . We are living in India. Back log of the court cases makes it extremely difficult for an individual to take on an organisation unless you have a backing of a Union or the media. Remember the pregnant employee who was fired from TCS and was taken back when the media went on rampage. You owe it to your family to give them a good quality of life, instead of you undergoing stress on account of the legal case and passing on the stress to them.

And in any case you have resigned and it will be difficult to prove that it was a forced resignation. So, take your time to ventilate your anger and go through the cooling period. And then look out for something else. Over a period of time you will put this behind. World is too big a place for brooding over some unfortunate incidents.nothing is permanent. Everything will pass and you will have your good times.

What you will achieve in legal battle? If at all you win, at what cost? Have you imagined what time, energy and energy you will be spending in this battle?
You will not have peace in your life. Your life will be full of revenge day-in and day-out my dear friend. Therefore we suggested you and once again suggest you to forget and forgive every thing what has happened with you and move on.
Also bare in mind that nothing is permanent in this world. You are not born for Accenture only. The world is waiting for you. Move on to it.

Having resigned, how you can prove it was forced? Please take such bad experiences as the real lessons and move forward.

Thank you all for your advise, I know it is tremendously difficult to forget and forgive when so many outrageous incidents have happened with you and you are incapacitated to perform any action against the wrong doers, but I guess time would turn out to be the best healer for me and GOD will deliver the justice.

Your language here clearly states that you are very loyal to Accenture, you don't even know what has happened with me and your comments clearly suggests you lack in common sense and bit of maturity.
I am equally sorry to hurt you with these comments, my be things like such has never happened with you and your biased response clearly manifests that. It is good to sit in your backyard and give advice but equally difficult to follow.
Anyhow well done for playing devil's advocate, may be that would win you some laurels in Accenture.

See you have been terminated on the ground of low performance . whatever target was given to you if you had completed that . Just make a note of it and have a word with Hr manager of the company. Their is no use of going for any legal complaints. Its better you try to talk to them or move on with some other companies. Their are lots of companies so it wont be an issue for you to get an job in same industry. Be positive and move on..

This PIP thing is a common mett used by all companies. They want to build paperwork before firing.
Find out labour commissioner for that address of company. Write a document with all details. Don't mention people against you and so on. It's subjective. Only mention real provable facts.
If you have old mails either client or HR take print outs and attach to this and post it to labour officer.
In that document Mention all the names of HR Who asked you to resign, exact words if you recall. Put their mail id and phone no.
Let's see what happens.
