Hi, I'm Ms. Ghosh. Needs ur help very urgently.
As per our company rules our office weekly off is satureday & sunday. I want to go for a leave on friday which is 23rd January 2015, the days are after the date is 24th is satureday, 25th is sunday and 26th January 2015 is monday so my Hr department inform me that I'll be marked absent for all the 4days (23rd January to 26th January). My question is that 26th January is our National Holiday so How can be one will make me absent for that day?? Is that justified?? Please make the confussion clear urgently..

Holidays which fall in the criteria of 'National Holidays' are 26 January, 15 August and 02 October. Saturday and Sunday both are weekly off in your company and 26 January is a national Holiday. Only 01 day ( 23 jan 15) will be counted as on Leave. Your HR is either uneducated or don't have spine to stand for companies employees.
Hope this clears your doubt.

In my previous company ,they used to say if you taking leave on friday ,saturday and sunday will also be counted as leave (stated as sandwich) as per government law . is it true ????.

I have heard some small time companies with limited employee strength do it. However, this is incorrect. For more details please go through Para 9 (1),(2) & (3) of Industrial Employment Standing Orders 1946. As a matter of fact, employees use Saturdays/Sundays as prefix and suffix to gather more holidays during their limited part of leave. i.e. a five days approved leave from Monday to Friday becomes 09 days for the employees.

In the above case leave can be sanctioned provided that duty should be joined on 27Jan otherwise all the 3 days will be calculated as LOP.For availing NH,earlier or after presenty must.As per prevailing practice ,it is acceptable to all.

HR is wrong.Submit leave application under proper acknowledgment. Check the leave balance.
Report the transgression to Inspector appointed under Shops&Commercial Establishments Act, Payment if Wages Act (If wages are deducted) ,Labor Inspector, Employees/Trade unions Leaders....

Hi,Mr. Ghose, Mr Brijendra Singh is perfectly right. you will be marked on leave for 23rd,Jan.,only. Otherwise also prefix/suffix holidays are allowed with your leave. N.K.SHARMA

Thank you all for guid me like this way and clear all my confussions also. Sir I've joined duty on 27th January but still the Hr arguee about the leave matter, he sayed from 23rd to 26th it'll be count as "leave without pay"...in that case what to do & what step can be taken against this wrong deccission???please tell me...
