Dear Seniors,

I am writing with great expectations. I have a small recruitment consultancy and we are operating from Gurgaon. I sent an empanelment invitation to a recruiter who had posted requirement for a consultancy, she contacted and we started working together. I asked about the contract but she kept telling me that she is busy with recruitments and once she is free, will do the formalities. It was my first assignment and she sounded genuine thefore even I did not pressurize. However she sent me an email confirmation but that was from a gmail account. They selected my candidates after taking mnimum 2-3 rounds for each candidate. In her email she had mentioned about 3 months replacement guarantee. In the mean time, some candidates left, one was terminated and still 4 continued. After that also I kept on sending candidates as required by her. Now whenever I asked about the payments, she started telling me about some issues happening in their company. After following up for 6 months I contacted the CEO of the company, he very well knew about my work through that HR. Initially he said that I would be paid but afterwards he started avoiding and for the last time I contacted him, he is only asking me if I have signed the contract and not ready to make the payments.

I understand it was my fault to trust someone like this and not getting the contract signed. I am feeling cheated and would like to ask Seniors over here that based on the email confirmation, offer letter of the candidates, can I take any legal action?

Hello,
While I fully sympathize with your predicament, there is no easy way to get your grievance redressed.
You have realized your mistake in trusting some unknown party and have learnt an extremely valuable lesson.
Even if "litigation" is possible, it would prove extremely cost prohibitive.
I suggest for your consideration that you may write this experience off as a bad dream and an example of "high cost learning".
Start afresh and leave this experience behind so that it will not contaminate your present and future.
All I would say is that the world is a good place and people like this are an exception that one can do without!
Don't waste too much time and talent over this issue. Instead use your positive energies for moving forward.
Admittedly, it is easier said than done but that is the best way out of your predicament!

Thank you for your empathetic response, appreciate it. Though you are right that it is not easy for me to let it go, however I will move
on. By grace of God, I am now in a much better position and have added nearly 20+ clients in just 6-7 months.

I agree with the reply by Samvedan and I know you have left this episode behind. But since you are well off professionally, I advise you to engage a lawyer who will put legal pressure on the CEO of the company through the woman who sent e-mail. File reports against both. If you can put enough pressure legally and show that you can destroy their reputation online and otherwise, you money will come sailing home.
Think about it and act. I would not advise the same to someone who has just started out and finding it difficult to keep going. This will be a lesson to cheats like them since you may actually stop a re run on some other hapless victim otherwise they will have a free run destroying many more morals.
It is always the lucky who must fill in for the unlucky ones.
Anyway the choice is yours all the best.

I want to state quite unequivocally that the world at large does not conform to your unfortunate experience. Your experience was an sddity and not worth pursuing. It is better to learn a lesson and enrich yourself.
I am impressed precisely for that. Keep moving to realize your dreams.

@Robin: Thank you for your response..this is something which I wanted to do with the same intention..That CEO does not realize he is my linkedin contact and I could do a lot to defame him. But to be honest,I will not do it and thinking about this issue has already burnt enough of my energy which I could have channelized to grow my business..mine is a start up and it requires lot of work and patience. Also whoever read my post would not commit the mistake which I did. Thanks again!
I basically wanted to know if there is anything like consumer forum, where justice is easy and quick..being a mother of a one year old kid and my business ,which is my second baby will not give me that much time to fight for it.
