Hi,
I worked with an organization for 3.4 years and was my first job. I resigned and served 62 days notice period out of 90 days and requested HR and manager for early release due to some problem at home. Many of my colleagues left organization in 40,50 & 60 days based on manager approval but in my case manager didn't approved and forced to served 90 days. I was also ready to pay salary for non served period. I left the organisation without serving complete notice period. My company has marked me as absconding and holded my letters. Please guide me how can I get the letters and it that fair enough that company marked me as absconding in this case. This is baisness. I have already joined new organization without letter. I am asking this from my future perspective.

Comparing other cases does not help you. NP is 90 days as per appointment letter, is itn't? If yes, it is a breach of service rules. Better talk to your boss and convince him and get relieved officially.

Dear,

First please check your appointment letter, it must be mentioned that, you have to serve no. of days notice period or failure of the same, said notice period shall be recover from your dues. This practice generally follow by most of the organization to save their business loss & in same way to follow the law.

Secondly, as you said, you have completed more than half notice period, then do you have any written communication of about your notice period,,?

Third, before leaving did you intimate in writing to your company that, due to your personal problem you could not complete your notice period ..?

If yes, then logically absconding letter shall be null. you should reply back on that letter saying. same intimations has been done on time to time basis with all due respect & you are ready to get deducted the short fall of notice period with good will for company to avoid any business loss.

Write the letter very polite, logical & diplomatic ways & it should shows that, there is nothing intention about the company loss directly. which will be helpful, if in case, they are not agreed on the same, if you may required to do any legal case.

Dear Sir,
First of all, I could not find any clause in the policies that employee can be marked as absconding if he has resigned and didn't served complete notice period. Secondly, I Intimated company that I won't be able to serve complete notice period and I was ready to pay salary for the non served period. And, I have sent all the proofs to the company as a reply back on the letter and still they have marked me as absconding. Please guide me which step I should take now.
