If employee has consumed all his Paid leaves and he taken LWP on Saturday, Sunday and Monday would it count 3 days LWP or 2 days LWP.

Ideally Woff can not be deemed as LWP. YOu can not deprive him from his weekly off if are paying wages/ salary on 30/31 day basis.

Hello Madhuri, LWP means : leave with pay LOP means : Loss of pay If your company if following the sandwich rule than employee has to apply three days LOP. Regards, Ashish

Dear Madhuri, Every Organisation which follow sandwich rule will consider week off as LOP/ LWP if preceding And succeeding day of week off is LWP.

In cases of LWP (Loss of Pay Leave (approved leave) any intervening holidays or weekly off days need not be counted as per convention. However there is no hard and fast rule under labour laws as to how these holidays sandwiched inbetween should be treated. It's all depend on the leave policy/standing orders of the employer concerned. Whereas in case of normal leave like PL/EL/Sick leave these holidays sandwiched will be counted except when they are prefixed or suffixed but again the HR/Leave policies differ from estt. to estt. What labour laws says is that there shall be weekly holidays and other holidays as prescribed under state acts/rules.

this type of sandwich leave availing is not in favour of employees in manufacturing units to maximise the availability of manpower not to hamper the process. But in modernisation these type leave made easy.
In other units these type of leave can be permitted if situation permits.

As rightly said by Vispipatwa Sandwich rule is applicable only for paid leaves whether it is CL/SL/EL, but not applicable on LOP. So in this case the employee must be on 2 days LOP and not 3 days as per my view.
