I work in the MNC, though its Indian company, I see that every year, they are not following the Indian government declared Holidays and even gazetted holidays. and even in many cases many employees are working on 15th Aug and 26th Jan also,
Also those such employees are NOT at all paid 3 times on even twice the wage.
I wanted to know what law and enforcement can be done against these company.

2. Which state is the establishment operating from
3. Is there any list of Holidays declared by the company.

Govt of Karnataka has exempted IT and BPO sector from Industrial Standing Orders Act, 1946. Does your sector also enjoy similar exemption by the government of the state (in which your company falls into)?

i am surprise to listen this that company is not following two leave out of three compulsory leave i.e. 15th aug , 26 jan n 3 oct.
they supposed to give these leave and i guess 14 other leave according to their area and act applicability.
rest will be suggest by our respectable seniors.

Many of the MNC who work in BPO, KPO, Call center areas do not follow indian holidays as it is necessary for them to work according to their clients requirement. Most, however, pay Overtime for all national holidays. Again, they are giving you leave on certain other days which you do not have as an Indian (eg. July 4th)
What action do you plan to take against them ?
I hope you realise that if you make a complain, you are sure to lose your job. Your company is not going to keep you on roll once they find out that you have complained against them.
