I just want some information reagarding payment deduction without serving notice period. In my comapny if notice period is for two months but recently one employee left the organisation and he served notice peroid for 14days only. And now he is claiming for his salary as we have not relese his salary due to non compeletion of notice period. As our our policy The notice period/notice pay for discontinuation of service is Two months` notice or two months` basic salary in lieu . Please give me your suggestions to calculate his salary if we relese his salary. His Basis salary was 5000 and gross salary 20000. Please put your suggestions.

Dear Supriya,
As you have mentioned that an employee when take exit from the company has to serve 2 months of notice, and as this particular employee has not served the entire notice, legally he can not claim for the salary, instead to get his reliving letter he should pay you the remaining amount apart from the 14 days basic salary.
