I was employeed in a start up pvt. Ltd Company in pune, there only one person was handling the company. no HR or Finance department. i wasnt well so i informed abt med leave but he cancelled saying urgent work has come up but i was not given any work so i mailed him that this is insensitive behaviour. and next day i took leave, wen i resumed work the day after,i was told that i hv to resign. i didnt served notice period as i was told to resign the same day.
But when i asked for my salary & experience letter & relieving letter on 5th sep i was told that i was terminated. n now he is threatening me & warning me for not being smart & all, i will spoil your image in front of your parents and all, what should i do?? on 17th sep he gave me relieving letter & experience letter after me saying that, if im terminated i should get my salary n letters in 24hrs. I am being mentally harassed n i cnt concentrate on any thing else please i request u to help me.
i also want to know that as i didnt served the notice period will the company be liable to pay me the notice period amount, & what are any other compansetions i can get from the company, there was no PF involved.
What is Gratuity ?? am i Liable to get it??

Gratuity is a component, which means the employee who has served the company for 5 or more than 5 years, only then he/she will get the amount.

Since the employer has threatened you for no fault on your part,you may complain to police and lodge a case.

thank you so much for all your replies but still im clueless abt my situation handling.. as i didnt serve the notice period & there is no proof of the fact that employer asked me to leave immediately in this situation what are my rights, will i be getting my last month salary?? though i got relieving letter & experience letter stating that my dues will be settled.can i file a case ???

in this case you will be getting you pf, no employer can stop the pf, second as they have given you experience letter, it says that you have resigned from the company on your own interest, so this is better you have your experience letter that you have worked and you can try else where.
regarding your last month salary, do keep them posted through your emails to the head of the department escalating on the topic, if they do not turn up you can proceed to the nearest labour officer and lodge a complaint against the employer by showing your follow up emails for your salary.
