I have been employed with an organization for the past three years and currently hold a senior position. Since July 2013, there have been delays in salary payments, leading to a backlog of five months. Form 16 has not been issued, and TDS tax has also not been paid to the IT department.

By "senior position," I understand that you are in a managerial role. If so, you will not receive protection under labor laws. Instead, you will have to pursue the matter as a civil case based on the violation of the contract. For workers, naturally, the provisions of the Payment of Wages Act would assist in recovering the amounts due from the employer.
