Hello,
I was going through this site and came across a topic that was to my interest.
But everybody there was just talking about the working on Sundays. No one really discussed National Holidays.
I work for an offshore IT Software Development company in Gujarat. We do get off for other festivals like Holi, Diwali, even Rakshabandhan and Janmashtami. But we work on National Holidays. The reason given to us is that since the clients are in the US, we have to work according to their schedule.
Now my question is, in this scenario, is it valid to work National Holidays and if we are working on US standards, shouldn't we get Christmas and Thanksgiving and 4th of July?
Thanks,
Megha

There are 2 scenarios in IT industry.
IF you are working for US client than you will get leaves as per US calendar.
If you are working for US client you will get leaves as per Indian calendar.
This is decided by the client while setting up the project, but every employee is entitled to get 9 or 10 national holidays.
Thanks

Dear,
The Organization may not provide holiday on Rakshyabandhan or Janmastami but have to declare and provide holiday on National Holidays i.e. on 15th August, 26th Janwary, 2nd October and 1st May.
If the Organization is forcing Employees to work on National Holiday, it means they are exploiting Employees and Cheating the Govt. too.
Definitely, that is a Cheap Management.

Dear Deepa, I would like inform you that, there are only Four National Holidays in India and remaining are coming under Festive Holidays, which should be given according to the majority of Employees.

Thanks Deepa Bhatia. We do get 10 festival holidays.
If we are working as per US calender (i.e. Christmas, Thanksgiving, 4th July, etc.) would it then be okay to work our National Holidays?

Yes if you are working as per US calendar then you need to work on National holidays of India.
My brother is in Capgemini and there are so many projects that work on national holidays ...15 Aug and many more, he gets holidays as per US calendar

Dear pkmbgr13,
Thanks for your concern, but nobody is forcing anybody here. The employees are only too have with the current arrangement. I just wanted to get a legal viewpoint on this.

However, you are working for the US client, but you are working in India and should get leave on national holidays if there's no such agreement signed regarding leaves as in many cases leaves are decided while assigning a project for US or any other overseas client by mutual agreement, may be it as per US calender or Indian calender.

Dear Couvery,
There is a great difference between Leave and National Holiday.
And Dear Friend Deepa,
This is not regarding, who had attend job on which day. For your Information, I had also worked on Independenceday and many but this is not Legal and Ethical.
Please, let me know, if there is any other updation on Holidays.

Who ever is the client the IT companies are establishments under the National and Festival holidays Act of the respective states. The employees are eligible to get holidays as per the Act.But employees can be allowed optional holidays equal to the festival holidays.Tuis is not permitted for national holidays,But as It companies work for 5 days in a week usually labour authorities are not adamant on holidays.
