Dear Neha, if your employee has completed 80 working day then she is eligible for the maternity benefit. Regards Rajbir

If she works 80 days in a preceding year to her one year before expected date of delivery then only she is eligible.Hence we have have to calculate based upon the edd. Raju

if your are coming under the ESIC benefit then you will not be entitle for the benefit of maternity under maternity benefit act 1961.
there would be 10 persons and in that any women is there then that the maternity benefit would be given.
you must have been working for 80 days. and you have to give notice of leave before 6 weeks and should mentioned dates. then you will get the maternity leave with wages.
