Can any one tell me the standard procedure for calculating the salary... from the gross salary ,,, basic will be 40% or 50%.. and then one of our employee's gross salary is 10000. whether he is eligible for ESI Act...

There is no any standard procedure for Salary Break-ups. All what we have to keep in mind while preparing breakups is just to reduce Tax on employees. For gross pay of Rs. 10,000/- you shall design format any how. Even what you have prepared is good enough. Make sure as basic & DA is not less than Minimum wages as per the act.

As per the ESIC act employees who are getting more then 15000/- as a gross they are not entitled for ESI. If the gross salary is below 15000/- only eligible to get ESI.
