Can you pl. let me know that what are the necessary documents to be received along with the monthly bill from the Sub contractor (Labor contractor and Security Agency) and after getting those documents only the bill can be paid. Other wise bill could be hold.

Hi,
The following things need to be ensured as a principle employer, at least...accordingly documents can be collected from the contractors.
1) Copy of attendance registers / wages registers for the previous month - Self declaration from the authorized person (above the supervisor level) saying that salary has been paid to the contract labours.
2) Copy of PF paid challan
3) Copy of ESIC paid challan
4) Copy of any other statutory remittance challan (based on the applicability - Professional Tax / Labour Welfare Fund)
5) Self Declaration from the contractor saying that all statutory registers are updated as on........

I. Copy of Wage register (Contract Labour Act) with signature of the workmen
II.PF Challan (for the contribution of the previous wage month)
III. ESIC Challan (for the contribution of the previous month)
Iv. ESIC Return (Half Yearly)
V. PF Return ( Annually)

Dear Sir, In my opinion, since now a days , the Principal employer is held responsible for all statutory compliances in respect of contractor employees, as such I will suggest that, Principal Employer must obtain copies of all statutory returns as prescribed ,relating to the employees taken on contract, as required under each law as it has been observed that contractors are generally not following the statutory provisions as applicable to them which ultimately result into levy of Penalty,interest, prosecution etc. ,etc.

For confirming the deduction of the PF & ESI to the correct persons please ask for Form 5 & 10 and copy of ECR copy which will have the details of contract workers with their PF amount. Please confirm that the PF / ESI / Professional Tax Deduction amount and Pay/Wage sheet amount must match with the concerned challan break up details, and the Wages sheet should match witht the attendance register produced by the contractors.
