Hi All,
I put my notice in my organisation on 20 june 2012, so that i can join my new company after 1 month of notice.
After 10 days, on July 1 2012, the employer comes and tells me that i had a security breach and will be terminated immediately.
Now, my new employer says they need my releaving letter from the previous organisation. But my previous organisation is neither giving me a releaving letter nor resignation acceptance letter and they say my full and final will be given after 1 month along with the termination letter.
Kindly help me on this. What should i do? Do i need to go and consult a attorney? Any suggestions please.

You can be terminated even after rendering your resignation. Some people begin to take things for granted after giving resignation. They begin to say bad things about company. They also try to STEAL their files and data from the system, without even consulting the Systems Department. If you have done any of the following then your case is weak and the company can terminate you.

You need to check with your previous Company as to the exact reasons for security breach. What was the exact security breach, attributable to you. Was a Show Cause Notice issued to you or an Enquiry conducted by the Company. If not then you can seek this clarification from the Company and you would have a good chance in the Court of law. Consult an Advocate.

The very first thing, they can’t terminate you without giving proper details of this “Security Breach”. Has they issued you a notice, any information and letter regarding this? However, you are an employee of them and if found you guilty they deserve the right take action against you and seriously would not be a good thing for you. You can share the complete things with us so that we can give you the proper solution of your problem. I don’t know why but found here something lost so let me request you again to furnish more details about it.
Second, if they have terminated you immediately would have been issued a Termination letter with the certain reason. Please let us know about it. Don’t worry about your F&F along with all dues and EPF this they can hold in anyway.
And what about your previous/last employer, why they not issued you relieving letter and resignation acceptance, is that you have left the job with some reason without serving NOTICE PERIOD with them and been declared ABSCONDED. WHY SO

You should be happy they are not taking any action against you after found breach of contract, If they are ready to give letter after completing notice period then you can submit to new employer. You should also clarify that I have not done any illegal activity during employement so they do n't delay your further settlement.

Please give us the whole story as Anil has requested. Also, kindly consult a lawyer if the organisation has not given you any reason. The lawyer should be able to get that information by issuing a notice. Whether the new organisation will still accept you depends upon the wording of the termination letter and the seriousness of the breach.
