I worked for a software company for about 2.5 years. In this tenure, I was promoted to team lead within 1 year. Recently, as my father was not doing well, I was not able to give full commitment to the company. In other words, I was not logging in on time and was taken offs as and when circumstances demanded. Last month, my manager called me in for a meeting and asked me how long will it take for me to get back to work as usual. As things were not good at home, I was not able to give him any specific duration. Within next week, I was asked to submit my ID card and was asked to leave the company. When I asked about FNF and experience, they asked me to talk to HR. After following up for about a month, I get a reply from HR that I need to pay them two months salary for my NP to get my relieving letters or else I will be getting a termination letter from the company.
Please advise as to what should be my next step...

I'm working with one of the leading NBFC in delhi.since 18 months .Im not satisfy from company due to harrasment by Reprting manager.He always using abusing languages in front of Everybody in the office Premises. so i resigned from the company in the month of Jan'15 in the 7days Short Notice Period.but my Reporting manager not accepted my resignation he keep ignouring me.On last day of my notice period i send the mail regarding my resignation acceptance.but no rply from him.on my previous mails also i mark this mail to my HR,SR.HR,HR Head Also. On next day i send the resignation Acceptance mail to my HR HEAD but still i NOT receive any kind of Reply .I keep send the mail to my HR HEAD regarding the same & mark cc to all .Yesterday i mark the mail to my Company MD & CEO regarding the Resignation acceptance but rply from him but a very next minute i receive a mail from my North head that
Dear .........

I'm already send the resignation mail on 20th Jan regarding my resignation & last working day is 27th Jan. Also i send the resignation acceptance mail to my HR HEAD on 28th Jan
So,please guide me what should i do ????

You were very categorically told that you will be required to handover the duties to your supervisor, arrange the issuance of all your cases and then you would be relieved of your duties wef 3rd Feb at the earliest.
This now constitutes a dual employment case. You may wish to discuss this with your current organisation.
So,please suggest what should i do ???

This is a very interesting situation.
They have asked you to leave the company.
They have therefore, the right to issue a termination letter.
I assume they will pay you the notice pay and pending salary with your f&f asper your terms of employment.
However, they are giving you a chance to avoid a termination letter as it will make it difficult to get a job later.
They are asking you to give a resignation letter with notice pay for short notice and get the relieving letter you need. That makes sense for saving your self of trouble later,
However, they are also taking steps to avoid problems later with you.
Their termination may be unfair labor practice, specially since they didn't hold a domestic inquiry. The recent case of labour court hearings for TCS has made they realise not they can't always get away.
You need to take a call on whether you want to and can fight. The fight is long and costly. Your attention is now with your father and I think it's better for you to drop it
