Dear All
We are a civil contracting company. On each project we employ our permanent staff and also engage contractors which undertake the job on labour rate i.e. they charge us the labor rate on a per square meter basis. The contractor gives us only labour and we supply all the material. Such payments show as JOBWORK in our balance sheet. Please advice if we are liable to pay esi / pf on the jobwork piece of our balance sheet.

Hi,

Its the primary responsibility of the Contract concerned to comply with all the applicable Statutory and your organization, being the principal employer in this case, have to ensure that the contractor you are engaging complies with all the enactments. In case he fails, you have to take up all the responsibilities on his behalf.

My suggestion shall be :

i.While engaging any contractor, ensure they have valid PF,ESIC & Professional Tax Registration

II. Instruct all your contractors to submit the monthly challan for PF,ESI and P.Tax remittance along with the monthly invoice without which no bills shall be processed.

III.Instruct the Contractors to submit the Half-Yearly return for ESIC and Annual Return for PF.

Iv.Ensure the contractor pays over and equal to the prescribed "minimum Wages" rate as applicable fr your state.

V.Ensure your contractor takes the Labour License on reaching the critical size of manpower deployment (either 20 or 10 depending on the state)

You can also consider our expertise in Contract labour service, that we offer on pan india basis.
